Our Privacy Policy ("Policy") outlines how we collect, use, process, and disclose personal information when you utilize any of our Services, website or interact with a Merchant using our Services. We may update this Privacy Policy periodically to reflect changes in our privacy practices, operational procedures, or regulatory requirements. In the event of material changes to this Policy, we will provide notice by posting the revised policy on our Website and, when appropriate, through other communication channels. By continuing to use our Website or Services after such changes are implemented, you consent to the updated policy.
Websites and services co-branded with Ackroo may present or link to a shared privacy statement or individual privacy statements, in addition to our Policy. If you have any inquiries, please reach out to us via email at privacy@ackroo.com.
We maintain relationships with various parties and consequently collect information on:
- Merchants: Businesses and entities contracting our Services.
- Customers: End users engaging with our Merchants.
- Partners: Entities that facilitate and promote our Services
- Others: Individuals interacting with us via our physical locations, website, or applications available on point-of-sale devices, payment terminals, and mobile devices.
This Privacy Policy applies to all the aforementioned parties, and the terms 'you' or 'your' herein refer to any such party.

BY SUBMITTING ANY INFORMATION YOU ARE ACKNOWLEDGING THAT YOU HAVE READ AND UNDERSTAND THIS POLICY AND THAT YOU AGREE TO BE BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS OF THIS PRIVACY POLICY, SIMPLY EXIT THIS PAGE AND/OR THE APPLICATION WITHOUT ACCESSING OR USING ANY OF OUR SERVICES.
2. Type of Information Collected
We process personal information with careful consideration for potential privacy risks, limiting the scope of information retained and the purposes for which it is used.
Our processing of your personal information is primarily based on:
- Contractual Obligation: We process personal information to fulfill contractual agreements with our Merchants.
- Legitimate Interest: We process personal information to facilitate business relationships among the parties involved, such as enabling our Merchants to enhance their customers' experience.
- Legal Obligation: We may process personal information to comply with legal requirements, such as record-keeping obligations associated with financial services.
In instances where we cannot rely on an alternative legal basis for processing or where required by law, we may process personal information based on your consent, particularly in the context of certain sales and marketing activities. You have the right to withdraw your consent at any time by adjusting your communication preferences or contacting us directly.
Below is a list detailing the information we collect from our Merchants and the corresponding purposes for which it is collected:
- We gather account-related information such as your name, company name, date of birth, address, email address, phone number(s), government ID details (for payments only), and payment information (i.e. credit card and banking details). While we may collect payment information to process transactions, we never hold or store your credit card information.
This information is used to deliver our services, which include enabling secure access to your account through authentication, generating invoices, offering support and resolving issues, and enhancing our product offerings by monitoring for defects and user experience issues. - We gather data regarding the Ackroo point of sale, payment terminal, mobile and web applications you have registered to use, our Merchant Program Console, as well as the websites you visit. Additionally, we collect information about how and when you access your account with us. This includes details about the device and browser you use, your network connection, IP address, and your navigation through our platform interface. Ackroo may also collect aggregated data or anonymized data that does not directly identify you.
We use this information to enhance your experience with our services in several ways. By analyzing your app interactions and usage patterns, we can identify areas for improvement, detect and fix defects, and ensure a better user experience. We also protect our product and clients from security threats and fraud. Additionally, we tailor your in-app experience based on your previous interactions, highlighting features that you might find useful but haven't yet explored. We communicate with you to help you get the most out of the product, informing you about new or unused features that could benefit you.
Our collection of program console usage information may involve the use of cookies. Cookies are small data files stored on your hard drive by a website. Ackroo may also collect aggregated data or anonymized data that does not directly identify you. We may combine information we collect about you with information we receive from third parties. - We gather and handle personal information concerning your customers, either shared directly by you or provided by your customers through their utilization of the services we offer to you.
We process this information on your behalf to provide you with our services, aiming to help you create exceptional experiences for your customers. This includes enabling the sending of gifts, facilitating and automating communication, and simplifying payment collection.
We will utilize personal information in other instances where you have provided us with your explicit consent. This information is handled in accordance with your expressed permission.
3. Utilizing Your Data through Third-Party Integration Devices
When you are a customer or Merchant that uses one of Ackroo’s products or services, we collect data from you via third party integration partner devices and associated merchant accounts information is collected including but not limited to, information such as name, address, phone number, email, business name, and time zone. We also collect information about the employees that have accounts as a part of that third party device. We collect their name and identifier.
Once you have downloaded the Ackroo Anywhere Program through any of our third party payment terminal or POS partners, you may be required to enter a username and password as well as confirm your email, program name, merchant name, phone number, and time zone to complete the installation on that third party partner’s device.
4. How Ackroo Uses Your Information
Ackroo may use your personal information in the following ways:
- We may use your information to update, secure, troubleshoot and provide support for our products. It also includes sharing data, when it is required to provide the service or carry out the transactions that you request.
- We may use your personal information to help authenticate you should you ever contact us for support.
- We may share information with companies including third party integration partners that provide support services to us (such as email or invoicing vendors) and that help us communicate to you on behalf of program owners. These companies may use information about you to perform their functions on our behalf.
- In the event of a merger, acquisition, financing, or sale of assets or any other situation involving the transfer of some or all of our business assets, Ackroo may disclose personal information to those involved in the negotiation or transfer.
- We may contact you with special offers, promotions, and/or sales inquiries.
- We may also share aggregated or anonymized information that does not directly identify you.
5. Third-Party Sharing
We are committed to safeguarding your personal information and will never sell or rent it. We will only share your information with third parties under the following conditions: to support our Merchants' growth, provide services to our Merchants, enhance the Merchant customers' engagement, comply with legal requirements, or if we have obtained your explicit consent, such as through programs like Scan Data.
We may disclose your information to prevent, investigate, or respond to illegal activities, suspected fraud, potential threats to the physical safety of any person, violations of our Terms of Service or other agreements related to our services, or as required by law.
Additionally, personal information may be shared with a company that acquires our business or the business of a merchant whose store you visit, whether through merger, acquisition, bankruptcy, dissolution, reorganization, or other similar transactions or proceedings.
6. Data Deletion
We understand; sometimes, you want your data to disappear. We are sorry to say goodbye, but your privacy is important to us. You have two ways to request the deletion of your data:
- Online Form: You can fill out the form here or email privacy@ackroo.com to request a full deletion of your data.
- In the App: Users and merchants with account information stored in our mobile app can initiate a data deletion request directly within the app.
This includes but is not limited to, the following: first and last name (if provided), phone number, email (if provided), and all related account activity details such as points and rewards. Once requested, our Product Support team will promptly remove your data from our system and confirm back to you when the action has been completed.
7. Canadian Anti-Spam Legislation Compliance
Ackroo has taken the necessary precautions to be CASL (Canadian Anti-Spam Legislation) compliant by:
Providing the option for cardholders to unsubscribe which is presented to the cardholder at the time the account is registered by the cardholder or merchant on behalf of the cardholder. This information is available to the Merchant and must be abided by in accordance with CASL. Ackroo will not be liable for any Merchant that is not compliant with CASL.
Ackroo may contact Merchants subscribed to the Ackroo service to communicate program changes, program updates, and promotions.

8. Personal Information Security
Ackroo takes reasonable steps to ensure appropriate physical, technical, and administrative security to help prevent loss, misuse, unauthorized access, disclosure, or modification of personal information.
While we work hard to safeguard your personal information, no system or transmission of data over the Internet or any other public network can be guaranteed to be 100% secure.
9. Updates to This Policy
We regularly revise our privacy policy to incorporate any changes resulting from new products and features affecting our privacy practices. Additionally, we include the last updated date, allowing you to determine the latest revision. You can access the most current version of our privacy policy at any time on our website.
